Terms of use
These terms are a contract between you and Lived-In Look. They sit alongside the Australian Consumer Law. Nothing in them takes away a right that the law says cannot be taken away.
1. Who we are
COMMERCE COLLECTIVES PTY LTD (ABN 57 669 401 432) (“we”, “us”) provides this service, which turns photos of vacant interiors into virtually staged listing images. When we say “you”, we mean the person who signs in, and any business that person is acting for.
2. The agreement
These terms start when you sign in or pay for a plan or credit pack, whichever happens first. By doing either, you agree to these terms and to our privacy policy. If you do not agree, do not use the service.
If you use the service for a business, you confirm that you have authority to bind that business. You also confirm that you are at least 18 years old.
3. The service
Lived-In Look lets you upload property photos, choose an interior style, and generate an AI-staged preview. You can regenerate a preview and, once you approve it, export a 4K image. The service is meant to add furniture, decor and styling while keeping the room’s architecture, windows and camera angle.
Staged images are digitally created. They are not photographs of the property as furnished, and they are not a promise about how a room will look, what a buyer will do, or what a listing will sell for. You must review every image before you publish it.
We may change, suspend or withdraw features so we can operate, secure or improve the service. If a change materially reduces a subscription you have already paid for, section 16 explains how that works.
4. Accounts
You sign in with Google. You are responsible for activity on your account. Tell us promptly at privacy@livedinlook.com if you believe someone else is using it without your permission.
We can refuse a sign-in that Google has not verified, or that we reasonably believe is unsafe or in breach of these terms.
5. Your listings and photos
You are responsible for the material you upload and the instructions you give us. You must:
- own the photos, or have permission from the owner to upload and alter them;
- have permission to store the property address and other listing details you enter;
- not upload images of people unless you have the rights and consents needed to let us process those images as described in the privacy policy;
- not upload anything unlawful, infringing, or that you are not allowed to use for advertising.
You keep ownership of your photos and listing details. You give us a licence to host, reproduce and alter that material, and to send it to the service providers named in the privacy policy, only so we can provide the service, secure it, and support you. The licence ends when we delete the material, except for copies we must keep for law, billing or dispute handling.
As between you and us, you own the staged images we generate for your account. Similar prompts can produce similar images for other customers. We do not promise that an output is unique or that it is free of third-party intellectual property claims. Check images before you publish them.
6. Honest advertising
Virtual staging can mislead a buyer if it is presented as a photograph of the property. You must disclose that an image is virtually staged or digitally altered wherever you publish it, including where Australian Consumer Law or a state or territory real estate or advertising rule requires that disclosure. We expect you to disclose it even where you are unsure.
You must not use the service to misrepresent a property, including its:
- size, layout, architecture or camera perspective;
- fixtures, finishes, views, light or condition;
- inclusions, or what is being sold.
You are responsible for checking every image against the real property before it is used in a listing, brochure, social post or advertisement. Compliance with the Australian Consumer Law and with the property and advertising laws that apply to your agency is your responsibility.
7. Plans, credits and prices
Paid use is through a subscription plan or a one-off credit pack. Current plan names, credit allowances and prices are shown on the site and again at checkout. Prices are in Australian dollars. The amount you confirm at checkout is the amount you pay. If GST applies, it is included in that amount unless the checkout page says otherwise.
Credits work like this:
- One credit produces one staged preview of a photo.
- The first regeneration of each photo does not use a credit. Later regenerations use one credit each.
- The 4K export of an approved preview does not use an extra credit.
- Plan credits refresh each billing month. Unused plan credits do not roll over. A yearly subscription is billed once a year and still refreshes the monthly credit allowance each month.
- Pack credits do not expire while your account is open. They are used after plan credits.
- If a preview fails because of a fault on our side, we return the credit to the balance it came from.
A subscriber may be offered a discount on packs. The discount, if any, is the one shown at checkout.
We may change prices or credit allowances for future purchases and future renewals. A price you have already agreed for the current billing period does not change. We will show a new price before we charge it. You can cancel a subscription before it renews if you do not agree to the new price.
8. Payments, renewal and cancellation
Payments are processed by Stripe. We do not store your full card number. Stripe’s terms also apply to the payment.
Subscriptions renew automatically, monthly or yearly, until you cancel. You can cancel at any time from the billing page, which opens Stripe’s customer portal. Cancellation stops future renewals. You keep the plan until the end of the period you have already paid for, unless the portal tells you the cancellation is immediate. When the subscription ends, unused plan credits expire. Pack credits stay on the account.
We do not refund a billing period that has already started, or a credit pack, merely because you have changed your mind. That limit does not apply where the Australian Consumer Law requires a remedy, including a refund. If we cannot supply the service for a reason on our side, or you have a right to cancel because of a major failure, we will refund the unused portion that the law requires us to refund.
If a payment fails, we may suspend new generations until Stripe confirms the account is up to date.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with the service, you are entitled to cancel the contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the problem rectified in a reasonable time and, if that is not done, to cancel the contract and obtain a refund for the unused portion.
Where the law allows us to limit a remedy, and it is fair and reasonable to do so, we limit our liability for failure to comply with a consumer guarantee to supplying the service again or paying the cost of having the service supplied again.
10. Acceptable use
You must not:
- break the law, or help someone else break the law, with the service;
- interfere with the service, probe it for vulnerabilities, or bypass access controls;
- resell access to the service, or present it as your own product;
- upload malware or content that is unlawful, hateful, or sexually exploitative;
- use the service to build a competing model from our outputs in bulk.
Using the service to stage listings for clients whose properties you are authorised to market is an ordinary use, not a resale of the service.
11. Our intellectual property
We own the service, including the software, style presets, branding and site content. We grant you a limited, non-exclusive licence to use the service while these terms are in force and your account is in good standing. You may use staged images you generated for your own property marketing, and for clients you are authorised to market.
12. AI output
Previews and 4K images are produced by third-party artificial intelligence models. Output can be wrong, distorted, inconsistent, or unsuitable for a listing. We do not promise that an image will be free of artifacts, will match your prompt, or will be accepted by a portal, vendor or client.
You decide whether an image is fit to publish. We are not responsible for a listing, campaign or transaction that relies on an image you chose to use.
13. Privacy
We handle personal information as described in the privacy policy. Uploading a photo and starting a generation sends that photo and your styling instructions to overseas providers. The privacy policy explains that disclosure and the consent it relies on.
14. Suspension and ending the agreement
You may stop using the service at any time and cancel a subscription as described above. You may ask us to delete your account by emailing privacy@livedinlook.com. Download images you want to keep before you do. If you close your account, unused pack credits are not refunded, except where the Australian Consumer Law requires a refund.
We may suspend or close an account if you break these terms, do not pay, or if we need to do so to comply with law or to protect the service or other people. Where it is reasonable, we will tell you first and give you a chance to fix the problem. We may act immediately if the issue is serious, including unlawful content, a security risk, or non-payment.
If we withdraw the service as a whole, we will give you reasonable notice where we can, and we will refund unused pack credits and the unused portion of any prepaid subscription period you can no longer use.
15. Liability
Nothing in these terms excludes, restricts or changes liability for consumer guarantees, for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.
Subject to that, and to the extent the law allows, we are not liable for loss of profit, revenue, goodwill, or anticipated savings, or for indirect or consequential loss. Our total liability arising out of these terms or the service in any 12 month period is limited to the fees you paid us in that period. This cap does not apply where section 9 gives you a broader remedy.
You indemnify us against loss suffered by us because of a third-party claim that your photos, instructions, or the way you published a staged image were unlawful or infringed someone’s rights, except to the extent the loss was caused by our breach of these terms, our negligence, or a failure of a non-excludable guarantee.
16. Changes to these terms
We may update these terms by posting a new version on this page and changing the date above. If a change materially reduces what you receive under a subscription you have already paid for, it applies from the next renewal, not to the period you have already paid. We will take reasonable steps to draw a material change to your attention before that renewal. If you keep using the service after the updated terms apply, you agree to them.
17. Governing law
These terms are governed by the laws of Australia. You may bring a claim in the courts of the State or Territory where you ordinarily reside, or in the courts of the Commonwealth. This does not affect any right you have to take a complaint to a regulator, including the Australian Competition and Consumer Commission, your state or territory fair trading agency, or the Office of the Australian Information Commissioner.
